When to Continue ACA Filing

You must continue ACA filing for any employee and their dependents who elect to remain enrolled in coverage after termination of employment.
Examples include:

  • COBRA coverage following termination.

  • Post-retirement coverage for a retired employee who continues enrollment.

This requirement only applies when the organization’s medical plan funding structure is Self-Insured or Level Funded.
